~~ Homework or no homework? That's a difficult question. According to research, student achievement has little relationship to whether or not the class has assigned homework. In elementary grades, teacher assigned homework actually correlated to students' poor attitude toward school. Achievement DOES relate positively to how much time the parents spend assisting with homework which should come as no surprise to anyone. Cooper, et.al. 2001. Journal of Experimental Education. vol 69 2 ; 181199 and Journal of Educational Psychology 1998 ; , vol 90 1 ; , 7083. INTELLIGENCE ~~ Music lessons make children smarter. So says brand new research out this month from the University of Toronto. Researchers found that children's IQ scores increase an average of 1 point per 6 months of lessons. So, in theory, a child taking music lessons from age 7 to age 12 would have an increase of 10 points in their IQ due to the music. We will be watching this research as details are released. Schellenberg, G. et al 2006 ; Journal of Educational Psychology, Vol 98, 2 ; . ~~ Children with the fewest numbers of siblings perform the best on tests of intellectual skills and educational achievement. The reason for this appears to be that additional children dilute parental resources. These resources would include time, money and interactions. Downey 2001 ; . American Psychologist, vol 56 6 7 ; , 497504. ~~ Sickle Cell Disease SCD ; can affect the cognitive functioning in children. A study out of the University of South Carolina shows a relationship between SCD and lower IQ scores. Schatz, J. et al. 2002 ; . Journal of Pediatric Psychology, Vol 27 8 ; , 739748. ~~ Children born with verylowbirthweight, can attain normal cognitive functioning by schoolage. Researchers in Sweden studied large groups of 5 and 6 year olds who had very low weights at birth and compared their IQ and task performance with a control group of children. While there was a much wider variety in IQs among the low birthweight children, and many were low on the performance subscale, most fell well within the normal range of intelligence. THE ADHESIVE ARACHNOIDITIS SYNDROME continued ; MMC repair is inevitably followed by the development of arachnoiditis, fibrosis and adhesions between intraspinal structures, MMC closure predisposes to secondary tethering of the cord." They suggested that about a third of patients with MMC develop a symptomatic spinal cord tethering, which tends to present clinically as a progressive scoliosis, gait changes, spasticity or pain and sometimes with weakness, lower limb contractures and bladder dysfunction. Wagner and his colleagues noted that upper limb symptoms might also arise due to traction on the cervical cord. Whilst the majority of patients may gain some remission of symptoms by undergoing surgery, later recurrence is likely. Wagner et al. also remarked, "The subarachnoid spaces around the spinal cord regularly develop marked arachnoid adhesions after primary MMC closure." This may lead to arachnoid cyst formation in both children and adults. 2. Idiopathic spinal cord herniation: Berbel et al. 179 ; described a case of a man who underwent laminectomy for spinal canal stenosis, which did not successfully remove his symptoms. His presentation mimicked that of Brown-Sequard syndrome. MRI demonstrated ventral displacement of the thoracic spinal cord associated with an arachnoid cyst. At operation, the cyst was removed but attempts to free the spinal cord were unsuccessful due to severe spinal arachnoiditis. The authors suggeste d that whilst herniation of the cord is rare, that patients tend to present in a similar manner, with a gait disorder resembling that in Brown-Sequard syndrome. 3. Arachnoid telangiectasis: Buxton et al, 180 ; described a case of syringomyelia secondary to arachnoiditis arising as a result of arachnoid telangiectasia. The patient had no other signs of hereditary telangiectasia. 4. Spinal dermal sinuses In September 2003, Ackerman and Menezes 181 ; published a paper on 28 cases of spinal congenital dermal sinuses, in which they reported 22 tethered cords, 14 inclusion tumors, and 6 patients with evidence of arachnoiditis. The authors remarked: "Although most patients were referred for cutaneous stigmata evaluation, 50% had neurologic deficit, intradural tumors, or tethered cords and buspar.

A Form 2 application will be submitted when the applicant has not used a trade-mark in Canada but has made a trade-mark well known in Canada see section 5 ; in relation to wares or services by using the trade-mark in association with the wares or services in a Union Country, and by distributing or advertising the mark in association with the wares or services in Canada. However, these two claims will be accepted if they are for different wares services or if the "made known" claim precedes that of the "use" claim for the same wares services. An application which contains a "made known" claim and a "proposed use" claim for the same wares services is acceptable . A change in the basis of an application from "made known" to "use" in Canada is not acceptable notwithstanding that each claim is treated equivalently in determining entitlement under subsection 16 1 ; . Section 5 of the Trade-marks Act states that: "A trade-mark is deemed to be made known in Canada by a person only if it is used by that person in a country of the Union, other than Canada, in association with wares or services."[underlining ours] Furthermore, paragraph 30 c ; of the same Act reads: ".in the case of a trade-mark that has not been used in Canada, but is made known in Canada, the name of a country of the Union in which it has been used by the applicant or his named predecessors in title, if any, and."
